15 Years In Court: Why I Never Gave Up On A Consumer Rights Battle Against A Transport Company: Teile Express Motors Limited. – Nwabueze Obasi-Obi, Esq

In 2011, just one year after my Call to Bar, I made a decision that would test my patience, resolve, and faith in the legal system for the next decade and a half. I sued a prominent transport company, Teile Express Motors Limited.

The dispute began on what was supposed to be a straightforward journey from Abuja to Port Harcourt. I had paid for an air-conditioned bus, but instead endured a grueling, hot journey without AC. To make matters worse, upon reaching Onitsha around 6:30 PM, the driver stopped and abruptly announced that Onitsha was their final destination.

When I protested that my ticket was fully paid to Port Harcourt, I was met with indifference. I managed to get the phone number of the Abuja-based manager, who spoke to the local station staff. The “solution” they offered me? A mere ₦1,000 to “figure out” the rest of my journey. Left to my fate as dusk approached, I had to load my luggage onto my head, hop on a commercial motorcycle (Okada), and hunt for an RTC park. I arrived in Port Harcourt incredibly late, exhausted, and having completely missed a vital appointment.
Many told me to “let it go” and “chalk it up to experience.” Instead, I chose to use my newly acquired wig and gown to fight back and the fact that the court room was my farm kept me going.

What followed was a marathon. Over 15 years (we mobilised for heating notices and fought their delay tactics plus preliminary objection to the suit which was dismissed by Hon Justice Folasade Ojo before his Lordship’s elevation to the Court of Appeal), this case was transferred from one judge to another—four in total—due to retirements and elevations. But we persisted.
Recently, Hon. Justice Y. Halilu (the fourth judge to preside over the matter) delivered judgment in my favour, awarding general damages against Teile Express Motors Limited.

This victory is not just about the damages awarded today or the special damages lost due to unavailability of witnesses resulting from age of the case; it is a testament to the fact that no corporate entity is too big to be held accountable. To today’s younger lawyers: never let a breach of contract slide just because the system is slow. Justice delayed may test you, grinding slowly and surely, but when you stand your ground, justice will prevail.

  • Unlawful Suspension: National Industrial Court Orders Savannah Suites to Reinstate Chief Security Officer, Pay ₦2.5M Damages and ₦350K Costs

Unlawful Suspension: National Industrial Court Orders Savannah Suites to Reinstate Chief Security Officer, Pay ₦2.5M Damages and ₦350K Costs

The Claimant, Mr. Blessed Nehemiah, was employed by the Defendant, Savannah Suites Limited, a hospitality company located at No. 8 Faskari Street, Area 3, Garki, Abuja, as a security personnel in 2019. His employment was to be confirmed within twelve (12) months as stated in his letter of engagement, which the Defendant failed to do within time. Despite the delay in confirmation, the Defendant continued to retain and promote the Claimant, eventually elevating him to the position of Chief Security Officer.

On the 29th of November, 2023, the Defendant issued a letter of indefinite suspension without pay to the Claimant, pending the outcome of an investigation, the nature and status of which were never disclosed to him despite repeated visits to the Defendant’s office. After over six months without communication, the Claimant instituted an action before the National Industrial Court of Nigeria challenging the lawfulness of the suspension.

In a judgment delivered on the 9th of July, 2025 the Court found thus:

    1. That it is hereby declared that the purported indefinite suspension of the claimant by the defendant as contained in the letter dated 29/11/2023 is hereby declared wrongful, unlawful and illegal.
    2. The Defendant is hereby ordered to pay to the Claimant all arrears of monthly salary that have accrued in the sum of N55,000.00 from December, 2023 to when Claimant is reinstated with pay.
    1. An order is hereby granted awarding the sum of N2,500,000.00 as damages against the defendant.
    1. An order is hereby granted reinstating Claimant back o his employment with the defendant.
    1. Judgment is hereby entered. Cost of N350,000.00 is hereby awarded.

    T.R. Agbanyi, Esq.

  • FCT High Court Invalidates AMAC’s Radio and Television License Bye-Law

FCT High Court Invalidates AMAC’s Radio and Television License Bye-Law

The High Court of the Federal Capital Territory (FCT) has nullified the Abuja Municipal Area Council’s (AMAC) Radio/Television and Communication Mast Bye-Law, 2012. This landmark judgment follows a suit filed by Yaliam Press Limited, a security printing company, which contested AMAC’s demand for a ₦1,000,000 radio and television license fee.

    Background of the Case

On April 17, 2021, AMAC issued a demand notice to Yaliam Press Limited, citing the 2012 bye-law as the legal basis for the fee. The company objected to the demand and, on September 23, 2021, formally warned AMAC of impending legal action if the request was not withdrawn.

    The Court’s Ruling

The FCT High Court ruled in favor of Yaliam Press, declaring that AMAC lacks the constitutional authority to impose a radio and television license fee beyond what is stipulated under federal law. The court deemed the 2012 bye-law unconstitutional, unlawful, and unenforceable.

Key highlights of the judgment include:

    1. Lack of Legislative Authority: AMAC has no legal power to enact a radio and television license law in the FCT outside the provisions of the Constitution.
    2. Bye-Law Invalidity: The 2012 bye-law was declared unconstitutional, invalid, and unenforceable.
    3. Invalidation of Demand Notice: AMAC’s demand for ₦1,000,000 from Yaliam Press was ruled invalid, as the company does not operate radio or television services.
    4. Bye-Law Officially Set Aside: The court nullified the 2012 bye-law in its entirety.
    5. Restraining Order Against AMAC: The council is permanently restrained from further demanding fees under the invalidated bye-law.

    Legal Representation and Impact

Yaliam Press Limited was represented by T.R. Agbanyi, counsel from Y.C. Maikyau & Co. The ruling is a significant victory for businesses operating in the FCT, reinforcing the constitutional limits on local government taxation and preventing unauthorized levies.

This decision underscores the importance of legal advocacy in protecting businesses from unlawful financial demands. Y.C. Maikyau & Co. remains committed to upholding the rule of law and safeguarding the rights of businesses and individuals alike.
